CLINIC PI/PD/NON-MV MSC96-01955 05/10/1996 FULL DISMISSAL W/PREJ ENTIRE ACTION 07/24/1997 "Defendants are to pay $14,750.00 in new money to the Plaintiff. A credit claim is waived. Each side will bear their own attorney fees and costs. Plaintiff will execute a release of all claims against Defendants and a full dismissal will be filed." Excerpt from Jury Trial Minute Order, March 24, 1997, Hon. Judge John F. Van De Poel, Dept. 14., Clerk of the Court Randi Venhuizen, Deputy Clerk. (This case involved a personal injury claim against Encina because the owner of the veterinary practice placed an invisible wire trap fence at his property with the intent to "trip kids who skateboarded or rode their bikes through that area" and that if kids were injured by the wire "it would teach them a lesson." The plaintiff, Michael Ferrara was injured when "the front tire of his bicycle was caught on the wire which caused his bicycle to dead stop. The collision threw Michael Ferrara violently over the handle bars of the bike and forcefully into the ground. He suffered numerous injuries."
